Terms & Conditions for Participation in MTN Nigeria Communications Plc’s “the REVV Programme”

The following Terms of Use shall apply to all intending Participants in the MTN Nigeria Communications Plc (“MTN”) Programme “the REVV Programme”

  1. Definitions

    BCW: Business Crush of the Week

    Programme: refers to a series of activities comprising “the REVV Programme” promoted by MTN and geared towards re-starting the economy and enabling Small and Medium Enterprises (MSMEs) bounce back in spite of the effects of the Covid-19 pandemic, and shall include:

    • Access to information by Participants through the Masterclasses to be deployed by MTN;

    • Access to productivity support (cloud, data and voice) funding through collaborations with partners from MTN’s Enterprise Business division; and

    • Access to new markets by MTN supporting the MSMEs using MTN’s online social platforms.

    Participant: Any Micro, Small and Medium Enterprises (MSMEs) customer of MTN who voluntarily participates in the Programme by accepting these terms and conditions and taking steps for effecting such participation provided always that a Participant shall not comprise any individual who has a family relationship with or friendship with any member of the planning committee of the Programme.

  2. General

    MTN with its principal office at MTN Plaza, Falomo Ikoyi, Lagos, Nigeria, is launching the Programme, in accordance with the following Terms and Conditions.

    The Programme is an initiative for SMEs, proposed to run through to the end of 2020 in the first phase and will consist of a series of masterclasses targeted at over 10,000 Participants. It will include the delivery of empowerment tools for selected two hundred (200) small businesses and the provision of advisory services for many more.

    The Programme will bring together a combination of MTN’s Enterprise Business partners’ solutions and provide robust education and learning delivered through masterclasses led by industry experts.

    During the period of the Programme, the Terms and Conditions shall be available at no cost whatsoever to all the Participants at (“Programme Website”) and may be subject to amendments at any time, in MTN’s sole discretion.

  3. Programme Duration

    The Programme will run from its launch on [., 2020] up until [., 2020] or for as long as desired by MTN (hereafter “Programme Period”).

  4. Territory

    The Programme will be valid only within the Federal Republic of Nigeria (hereafter called “Nigeria”).

  5. Participation in the Masterclasses

    Participants will be required to pre-register for each Masterclass and this will be done via a dedicated web page on the Programme MTN Business Website. The sessions will be held via video-enabled online platforms (Zoom, Instagram Live, YouTube Live or any other platform chosen by MTN) and shall be recorded for content marketing and other future uses of MTN.

    The selection of the 200 SMEs by MTN, for further empowerment, will be broken down to twenty five (25) SMEs to be selected per Masterclass session.

    To fill our online registration form • By filling this form (submitting the form), you accept these Terms and Conditions and, further, agree to be a recipient of MTN’s marketing communications, emails, et. al.

    • Filling this form or participating in the Programme does not, in any way, mean that MTN endorses your business or is obliged to provide any support to your business.

    • Filling this form or participating in the Programme means you give consent to MTN to use your business in any promotional or marketing publications and to randomly select you/your business, where applicable, as the BCW.

    • Filling this form or participating in the Programme does not mean that MTN is obligated to select your business as one of the 25 SMEs to be selected after each Master class session.

    • Being selected to be MTN’s BCW does not translate to MTN endorsing your business.

    • • MTN reserves the right to showcase your business as a participant of the Programme without any liability/exposure whatsoever.

    • By filling this form or participating in the Programme, you give permission to MTN to reach you for marketing purposes in the future.

    • By filling this form or participating in the Programme, MTN reserves the right to showcase your business across online and offline platforms and media.

  6. Programme Target

    The Programme is open to all Participants, as defined above.

    A Participant hereby warrants and represents that he/she:

    • Is participating voluntarily,

    • Is not a family member or friend to any member of the Programme planning committee

    • has perused and has a clear understanding of these terms and conditions of the Programme,

    • is fully aware and accepts that participation in the Programme does not obligate MTN to implement the Programme or select it as a beneficiary at any stage,

    • is fully aware and accepts that any sums or efforts expended in participating in the Programme is solely at its risk and will not be reimbursed by MTN. Further, each Participant accepts that MTN shall not be liable for any indirect or consequential losses or for any loss of expectation or man hours.

  7. Image & Personal Data Release Indemnity

    Participants hereby agree that personal data supplied or photographs taken or video recordings (both of the Participants and their personnel) in the course of participating in the Programme may be used by MTN to monitor participation in the Programme, or to provide services from time to time, or for subsequent promotional or marketing purposes by MTN.

    The Participant(s) agree(s) to:

    • the use of their names, photographs and video recordings for any advertorial or promotional purposes by MTN;

    • the disclosure of their personal details by the MTN; and

    • Co-operate with any other reasonable requests by MTN relating to the publicity of the Programme.

    In this regard, Participants waive their rights to pursue any claims, litigation or claim indemnity from MTN for utilizing their pictures, photographs or personal details for the purposes of this Programme or for any other desirable purposes of MTN.

  8. MTN’s Rights

    1. 8.1 MTN reserves the right to do any of the following, at any time, without notice to the Participant:

      1. to amend, modify or alter these applicable terms and conditions of the Programme for any reason;

      2. to interrupt, modify or alter the Programme as necessary for any reason;

      3. to determine the selection of beneficiaries among the Participants;

      4. to accept or reject nominations received from Participants;

      5. to withdraw the Programme at any time.

    2. 8.2 Any decision taken by MTN regarding the Programme shall be final and binding.

  9. Eligibility to participate in the Programme

    MTN shall in its absolute discretion determine the eligibility of any Participant to participate in the Programme, both at the commencement of the Programme and at any time during the life of the Programme.

  10. Disclaimer

    The Programme is provided on an "as-is" basis, without any representations and warranties whatsoever from MTN. Each Participant agrees that its sole remedy against MTN for dissatisfaction, at any time, with the Programme is to stop participating and notify MTN thereof.

  11. Limitation of Liability

    In no event shall MTN, its officers, directors, employees, or agents, be liable to any Participant for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from:

    1. Errors, mistakes, or inaccuracies of content of the Programme; and

    2. Personal injury or property damage, of any nature whatsoever; and

    3. Your participation in the Programme.

  12. Governing Law

    All matters relating to your participation in this Programme shall be governed by the laws of the Federal Republic of the Nigeria.
